Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the nobitsy platform (“Platform”), operated by Omnez GmbH, Brandheide 4A, 22397 Hamburg, Germany (“we”, “us”, “our”). By creating an account or using the Platform, you agree to these Terms.

1. Definitions

“Platform” refers to the nobitsy website, application, console, Client Space, API and all related services. “User” refers to any registered individual or entity using the Platform. “Services” refers to the records, the assistant, the automations, the API and the Client Space provided through the Platform.

2. Eligibility and Registration

The Platform is intended for business use only (B2B). By registering, you confirm that you are authorized to represent the company on whose behalf you are registering. You agree to provide accurate and complete information.

3. Platform Services

nobitsy gathers the data of the sources you connect into one record per client and provides an assistant that proposes and, once you allow it, performs actions such as sending messages, invoices and reminders. nobitsy does not provide accounting, tax or legal services and is not an ERP; the statutory books stay with the systems and advisors you use for them.

4. The Assistant and Automations

The assistant acts only within the rules you set. A proposal you approve, and a rule you switch on, are your instructions; you are responsible for reviewing what the assistant sends on your behalf. We keep a log of every action on the client's record.

5. Fees and Payments

Subscription fees are charged according to the plan selected by the user. All fees are disclosed on our plans section and in the console. Fees are billed in accordance with the applicable plan terms. nobitsy reserves the right to update pricing with reasonable advance notice.

6. User Obligations

Users must not misuse the Platform, provide false information or engage in fraudulent activity. Users are responsible for having the right to connect the sources and to process their clients' data, and for the content of the messages, quotes and invoices sent through the Platform.

7. Intellectual Property

All content, branding and technology on the Platform are the property of Omnez GmbH or its licensors. Users may not copy, reproduce or redistribute Platform content without prior written consent. Your data stays yours.

8. Limitation of Liability

To the maximum extent permitted by law, Omnez GmbH shall not be liable for indirect, incidental or consequential damages arising from use of the Platform, including actions the assistant performed under rules you set.

9. Data Protection

Your use of the Platform is also governed by our Privacy Policy. We are committed to protecting your data in accordance with the EU General Data Protection Regulation (GDPR).

10. Termination

Either party may terminate the account at any time. nobitsy reserves the right to suspend or terminate accounts that violate these Terms or engage in activity harmful to the Platform or its users. You can export your workspace before deletion.

11. Governing Law

These Terms are governed by the laws of the Federal Republic of Germany. Any disputes shall be subject to the exclusive jurisdiction of the courts of Hamburg, Germany.
